By accessing or using Social Flex (the “Service”), operated by Kaziflex Technologies (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Social Flex provides an API service for extracting public data from Instagram posts and profiles (“Service”). The Service allows you to:

Submit Instagram post URLs for data extraction
Retrieve post metadata, images, and public comments
Access historical scraping jobs and results
Manage API keys and usage quotas

3. Account Registration

To use the Service, you must:

Be at least 18 years old
Provide accurate, current, and complete information during registration

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

Harass, stalk, or harm individuals

5. Subscription Plans and Billing

5.2 Payment

Paid subscriptions are billed monthly in advance. By subscribing, you authorize us to charge your payment method on a recurring basis. Prices are in USD unless otherwise stated.

5.3 Refunds

All payments are non-refundable except as required by law. If you cancel your subscription, you will retain access until the end of your current billing period.

5.4 Price Changes

We reserve the right to change our prices with 30 days' notice. Price changes will apply to subsequent billing periods.

6. API Usage and Rate Limits

Your use of the API is subject to:

Rate Limits: Maximum requests per minute based on your plan
Quotas: Monthly job limits as specified in your plan
Fair Use: Reasonable use that does not negatively impact the Service or other users

Exceeding rate limits or quotas may result in temporary suspension of API access. Repeated violations may result in account termination.

7. Data Ownership and Usage

Your Data: You retain all rights to data you submit to the Service.

Scraped Data: Data obtained through the Service is publicly available Instagram data. You are responsible for ensuring your use of this data complies with Instagram's Terms of Service, applicable laws, and data protection regulations.

Our Usage: We may use aggregated, anonymized data for improving the Service, analytics, and research purposes.

8. Intellectual Property

The Service, including its software, design, trademarks, and content, is owned by Kaziflex Technologies and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. This license does not grant you any ownership rights.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

Instagram may change its platform, policies, or APIs at any time. We are not responsible for disruptions to the Service caused by Instagram's changes.

9.3 Data Accuracy

We do not guarantee the accuracy, completeness, or reliability of scraped data. You are responsible for verifying the accuracy of data obtained through the Service.

9.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAZIFLEX TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Kaziflex Technologies, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Your use of scraped data

11. Termination

By You: You may terminate your account at any time through your dashboard settings.

By Us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or pose a risk to the Service or other users.

Upon termination, your right to use the Service ceases immediately. Data may be deleted after a reasonable period.

12. Third-Party Services

The Service may integrate with third-party services (Stripe for payments, Instagram for data). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

13. Governing Law and Dispute Resolution
